The German Patent and Trade Mark Office does not search for trade marks which have already been registered. For this reason, a trade mark can be applied for multiple times. Regular monitoring allows you to identify imitators in a timely manner and take action against them within the specified period for filing an opposition.

Taking action in case of trade mark infringement

Here we'd like to show you your options in the event of a trade mark infringement:

  • Claims for damages: if a trade mark has been deliberately registered for use, and revenue has been generated as a result, the trade mark owner is also entitled to claim damages.
  • The trade mark owner may also be entitled to cancellation, recall, destruction and publication of the judgement.
